Terms of Service
These Terms of Service ("Terms") govern your use of the SyncMeds iOS app and related services ("SyncMeds" or "Service"), operated by TinkyBink Inc. ("we", "us"). By downloading, installing, or using SyncMeds, you agree to these Terms. If you don't agree, don't use the app.
1. SyncMeds is not medical advice
Read this carefully. SyncMeds is a personal medication tracker and reminder tool. It is not a medical device, not a diagnostic tool, and not a substitute for professional medical advice, diagnosis, or treatment. Always talk to your doctor, pharmacist, or other qualified healthcare provider before:
- Starting, stopping, or changing any medication
- Acting on any warning, interaction notice, or suggestion SyncMeds displays
- Interpreting any information returned by SyncMeds's AI features
- Making any health-related decision
In a medical emergency, call 911 (US) or your local emergency services. Do not rely on SyncMeds.
2. Your account and data
SyncMeds does not require an account. Your medication data lives on your device. You are responsible for:
- Keeping your phone secure (enable a device passcode or Face ID)
- Enabling App Lock in SyncMeds if you share devices
- Backing up your data via the Export feature if you care about preserving it
- Accurately entering medication information and keeping it up to date
3. Subscription terms
SyncMeds offers a free tier and a paid SyncMeds Pro subscription. Pro is billed monthly through Apple's App Store.
- Payment is charged to your Apple ID at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage or cancel at any time in iOS Settings → Apple ID → Subscriptions
- A 7-day free trial may be offered for new subscribers. Your Apple ID is charged at the end of the trial if you don't cancel first.
- Refunds are handled by Apple. We cannot process refunds directly.
4. Acceptable use
You agree NOT to:
- Use SyncMeds for any illegal purpose or in violation of any laws
- Use SyncMeds to track medication for someone who has not consented to you tracking them (note: tracking a child or dependent you are legally responsible for is OK)
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Interfere with or disrupt the backend services used for AI features
- Submit abuse requests through the automated phone calling feature, or use it to harass any pharmacy, doctor, or other recipient
- Attempt to bypass App Store subscription verification
5. Third-party services
SyncMeds uses third-party services for optional features (see Privacy Policy for the full list). Your use of those features is also subject to the third-party terms:
- Google Gemini — governed by Google's AI Studio / Gemini API terms
- Twilio — governed by Twilio's terms of service
- OpenFDA — public service with no terms of use, but provided "as is" by the FDA
- ElevenLabs (optional) — governed by ElevenLabs' terms
- Apple App Store, iCloud, and related — governed by Apple's terms
We are not responsible for the availability, accuracy, or behavior of third-party services. If an AI service is down or returns an incorrect response, SyncMeds's core offline features will continue to work.
6. Disclaimer of warranties
SyncMeds is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or reliability.
We do not warrant that:
- The app will be error-free or uninterrupted
- AI features will produce accurate or complete information
- Pharmacy or doctor calls will successfully reach the intended recipient
- Drug interaction warnings are exhaustive — always check with a pharmacist
- Reminders will always fire exactly on time (iOS may delay notifications under battery constraints)
7. Limitation of liability
To the fullest extent permitted by law, TinkyBink Inc. and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, personal injury, or property damage, arising from or related to your use of SyncMeds — whether based on warranty, contract, tort, or any other legal theory.
Our total aggregate liability for any claim related to SyncMeds is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) $100 USD.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — for example, liability for death or personal injury caused by our negligence.
8. Indemnification
You agree to defend, indemnify, and hold harmless TinkyBink Inc. from and against any claims, liabilities, damages, losses, and expenses arising from (a) your misuse of SyncMeds, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) your use of SyncMeds's AI features to place calls that result in any legal or regulatory claim.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date at the top and notify you through the app on your next launch. Continued use after the effective date of the updated Terms constitutes acceptance.
10. Termination
You can stop using SyncMeds at any time by deleting the app. We may suspend or terminate your access to the Pro subscription if you breach these Terms, misuse the AI calling features, or engage in fraud against Apple's App Store. Termination does not remove your data from your device — use Settings → Delete All Data for that.
11. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law rules. You agree that any dispute will be resolved in the state or federal courts located in Santa Clara County, California, and you consent to their jurisdiction.
